KJM Fitness Ltd Membership Terms & Conditions

This information has been produced so that all members can be assured of an enjoyable experience when visiting. 

1. Membership fees

Membership fees shall be fixed by KJM Fitness Ltd (hereinafter KJM) and may be altered at any time. Members will be notified of any fee changes prior to the date of amendment.

a) On payment of a membership fee, a member is entitled to use the KJM facilities, subject to these T&C’s.

b) The first membership subscription shall be due and payable upon signing this agreement. Subsequent membership subscriptions will reoccur on the same day of the following month (if this is a non-working day it will be collected the next working day).

c) All membership applications must be via KJM’s website (Unless unable to so do, in which case an application can be made at KJM’s reception). All members are accepted at the discretion of KJM.

d) KJM reserves the right to reject any application for membership, or refuse admission, without ascribing any reason for doing so.

e) On acceptance of an application a member will be provided with (i) a membership card, (ii) entrance code or (iii) access via our downloadable app to mobile phones. These cards/codes will remain property of KJM and upon termination of the membership must be returned to KJM.

f)  Membership fees are payable monthly, in advance, by means of a debit card/direct debiting system offered by KJM.

g) Pre-paid and direct debit members must be 16 years of age or older.

h) If a member fails to pay any subscription fee or other monies due to KJM or if a member’s direct debit instruction is cancelled, they shall cease to be a member of KJM at that point. Reinstatement of membership simply requires reinstatement of payment.

2. Joining/Cancellation Fees

a) There are no joining/cancellation fees. However, the membership fee is paid, monthly, in advance of gym usage and cancellation must be advised in writing prior to the intended departure date to assist in administration.

3. Direct Debits

Monthly direct debits are a contract between KJM and the member and will continue automatically until KJM is notified otherwise.

4. Membership Cards/Codes

a) Members must carry their cards/code/mobile when visiting KJM to gain access to the facilities.

b) The loss of a card/code should be reported immediately to KJM and an administration fee per replacement card/code will be charged.

c) Misuse of membership cards/codes or usage of App will result in an immediate cancellation of membership.

5. Opening Hours

Members shall have the right to access KJM during displayed operational hours, located on our website and at the gym entrance. These are subject to change, excepting Christmas Day, Boxing Day, New Year’s Day and Easter Sunday, when the gym will be closed. For details of opening hours re National Holidays / the period between Christmas and New Year, please refer to KJM’s website and entry door notices.

6. Use of the facility

a) A member is entitled to use the facilities, however KJM may at any time withdraw all or part of the facility for any period or periods with notice, where applicable, in connection with any cleaning, repair, alteration, maintenance, security work, staff holidays or for reasons beyond the control of KJM. 

b) Members are required to book their gym sessions prior to attending via the app or website.

c) Day passes are available for the use of the facilities on a one-off basis, subject to a satisfactory completion of KJM’s health questionnaire. All KJM’s T&C’s are applicable to any day pass purchased and for the duration of gym attendance. Day passes can be purchased through our website or at the gym reception.

7. Smoking

Please note, KJM has a non-smoking/vaping policy throughout the facility.

8. Gym

a) All new members must undergo a health questionnaire and a basic supervised induction before using any gym equipment. Members who have any reservations as to their physical condition are requested to undertake a medical check-up with their GP or a professional practitioner, before joining and certainly before embarking on any form of exercise. Members are strenuously advised not to undertake any physical activity for which they are medically unfit. KJM does not accept any liability for any misuse of equipment and subsequent injury, health problem or death. The exercise programmes and facilities provided are designed with safety in mind, however their usage is entirely at the individual member’s own risk.

b) Appropriate gym footwear and exercise clothing must be worn at all times. 

c) Free weights are to remain on the designated matted area, at all times, and returned to the racks after use.

d) Members are required to wipe down any equipment after use, using the wipes provided within the facility.

9. Lockers

Members are asked to store personal belongings and valuables in the lockers provided, however all items are stored at the member’s own risk. KJM cannot be held responsible for any personal loss. Keys for each locker are to be returned to the locker upon the member’s departure. Loss or damage of keys must be reported to KJM immediately and will be charged. Lockers are provided on a session only basis. All items must be removed at the end of each session. Any items left in the lockers will be placed in lost property.

10. Safety and Hygiene

In the interest of safety and hygiene, no crockery or glasses are allowed in our facility and no pets are allowed, with the exception of guide dogs. Fire exit doors, which are clearly marked, for the safety of members must not be interfered with or blocked. In the event of a fire, members are asked to make their way out of the facility via the nearest available exit in an orderly manner. In the event of a fire all attendees must report to the meeting point, which is the car park located at the front of the building.

11. Lost property

All lost property found within the facility should be handed to a member of KJM staff. Items will be stored for one month and then donated to local charities.

12. Liability 

a) KJM will not accept any liability for loss or damage to member’s/client’s property, money, valuables or other personal property.

b) Property stored in lockers, provided by KJM, is stored at the owners own risk and no liability for the loss or damage will be accepted by KJM.

c) KJM cannot accept any liability for any accident to any member or guest that may occur on the premises other than a liability which may arise from the negligence of KJM or KJM's staff.

d) Any member who suffers an accident on the premises must report it immediately, providing all information as to the circumstances under which the accident occurred for insertion into the Accident Book.

e) Neither KJM, its health & fitness instructors or employees, servants or agents (including any independent contractor from time to time employed by KJM Fitness) shall in any circumstances whatsoever be under any liability whatsoever to the applicant for any loss, damage or injury (including death) whether accidental or otherwise of whatsoever kind arising during or resulting from participating in any exercise programme or use of KJM equipment.

13. Membership Termination

a) There are no termination fees and memberships can be cancelled at any time. To terminate membership please advise in writing to assist administration, (info@kjmfitness.co.uk) and simply cancel the monthly payment method. The membership will cease at midnight on the day prior to the normal day of monthly subscription collection. KJM is not liable to refund any monies.

b) KJM reserves the right to refuse admission and/or to expel or suspend any member/client immediately and without notice, if any member/client shall, in the opinion of KJM, cause nuisance or annoyance to the other members/clients/staff or guests; and for any breach of KJM’s rules or misuse of KJM facilities, or for any other reason which KJM may deem appropriate. In such an instance, termination of membership ceases immediately. KJM is not liable to refund any monies.

14. General

a) Food & drink or the consumption of alcohol/illegal substances is strictly prohibited in and around the facility. Cold drinks can be taken into the Gym in appropriate vessels, however any spillage will result in the immediate suspension of an activity, until cleared. Members/clients/guests must notify KJM staff of any spillage immediately.

b) Parking spaces are available free on a first come first served basis. KJM accepts no liability for the loss or damage to any vehicle or its contents.

c) Members/Client must at all times, observe the membership rules and comply with any reasonable directions which duty staff may give to ensure the smooth operation of the facility and the convenience and health and safety of our members and staff.

d) No credit shall be granted by KJM to any member. Any cost incurred by a member must be paid prior to activating any gym usage or programme.

e) Any dispute or difference which may arise regarding the interpretation of KJM’s terms and conditions shall be determined by the directors of KJM whose decision shall be final.

f) KJM reserves the right to amend the terms and conditions at any time and members will be notified via email. If any provision in these terms and conditions is declared illegal or otherwise unenforceable, the remaining provisions shall remain in full force and effect.

15. Privacy Policy

At KJM we take the security of your personal date extremely seriously and any date collected from members/clients will be processed in a fair, transparent and lawful way by our service provider TeamUp who work with the most respected financial partners using the latest technology to make sure every payment processed is trusted and secure.

16. Protection of Personal Data

Both parties shall duly observe all their obligations under current Data Protection legislation and other national equivalent regulations as specified above which arise in connection with this Agreement.

17. Miscellaneous

a) KJM will not be liable for failure to perform its obligations due toForce Majeure which shall include but not be limited to Government action, war, riot, civil commotion, fire, flood, epidemic, labour dispute, any Act of God.

b) This agreement is governed by the laws of England and is subject to the exclusive jurisdiction of the English courts.
